Commercial Litigation & Collections

This area is a primary practice area for most of the lawyers in the firm. We represent finance companies, insurance companies, homeowner's regimes, credit unions, banks, individuals and small business owners in reclaiming personal property and collecting debts and judgments. Bankruptcy (Creditor)

To meet the needs of our commercial litigation and collection clients, members of our firm have experience in representing creditors in United Bankruptcy Court. Some of the services we provide in this practice area include the following:

We subscribe to the PACER information service, so we can provide our clients with copies of relevant bankruptcy filings and the status of bankruptcy cases.

Administrative Law

The firm represents clients in all aspects of state regulation, including administrative appeals and litigation before the courts. Firm attorneys are well versed in the requirements of the South Carolina Administrative Procedure Act, which deals with administrative hearings and adjudication, administrative investigations, administrative officers and agents, administrative rulemaking, licensing, and regulatory enforcement. Firm attorneys have particular experience in the regulatory requirements that impact members of the convenience store and outdoor advertising industries and represent companies in those industries in administrative hearings and contested cases before administrative law judges. Some services our firm provides in this area include:

  • Applications and renewals for Beer and Wine Permits and Mini-bottle licenses
  • Representation in Protest Actions (both protestants and prospective licensees)
  • Negotiations with agency on penalties for violations
  • Appearance before municipal and county councils
  • Representation before the Administrative Law Judge

General Litigation and Appeals

The firm provides representation for its corporate and individual clients in all state and federal courts in South Carolina including magistrate courts, probate courts, circuit court, the South Carolina Court of Appeals, the South Carolina Supreme Court, United States District Court, United States Bankruptcy Court, United States Court of Military Appeals, and the Fourth Circuit Court of Appeals.

The firm also represents clients in appeals from these various courts.

Personal Injury and Tort Litigation

The firm has experience representing injured victims of automobile accidents and victims of unreasonably dangerous products. Our lawyers' experience in mediation and arbitration helps complement this area of practice by enhancing negotiation skills and providing a reference as to what is fair compensation.

Real Estate

The firm represents individuals and businesses in all proceedings and transactions that deal with real property-land and the structures attached to it. As part of the practice, firm attorneys prepare contracts for sale and purchase of real estate, deeds, mortgages and trust deeds, and other related instruments. The firm also provides closing services for real estate transactions. The firm has loan closing software designed to make the closing process more efficient.

Business Organization and Transactions

The firm assists regional and small business clients with the full range of legal services necessary to begin and run a successful business. The firm assesses client needs, guides clients in the selection of the correct type of organizational entity necessary to meet their business requirements and then prepares all documents required for incorporation or formation of partnerships and limited liability companies. The firm also negotiates and drafts agreements, documents and contracts to meet business inception needs, including:

Estate and Probate Planning and Administration

The law firm provides representation for a variety of estate planning matters, including the preparation of wills, living wills, trusts, and related financial planning documents. Firm attorneys take into consideration issues related to tax planning, life insurance and property transfer matters when providing estate-planning assistance. The firm is also available to assist with Estate Administration, including probate and non-probate transfers as well as legal advice and representation for guardianship matters, power of attorney, and related agency issues. The firm also represents creditors in filing and preserving claims in probate court.
